Terms of sale

1. Purpose

These terms of sale govern sales made on dropward.life, published by EACHR (a French sole proprietorship). Any order implies unreserved acceptance of these terms.

2. Product and service

We offer a Dropward badge: a small tag fitted with an NFC chip, to stick on the back of a phone. When tapped or scanned, it opens an emergency profile that you create and update at any time (blood type, allergies, medications, emergency contacts…). The service covers the badge itself, activation and hosting of the profile. Photos and descriptions are provided for guidance; slight variations in shade or finish inherent to the materials do not engage our liability.

3. Nature of the service (important)

Dropward is a tool that displays the information you enter, to help a first responder or a relative. It is not a medical device, not medical advice, and not an emergency service. Dropward never places an automatic call and does not replace emergency numbers (112 in Europe). In an emergency, always call the emergency services. You are responsible for the accuracy and updating of the information in your profile.

4. Prices

Prices are shown in euros, all taxes included. As a micro-business under the VAT exemption scheme, VAT is not applicable (article 293 B of the French General Tax Code). Any shipping costs are stated before you confirm your order.

5. Order and payment

An order is confirmed once payment is validated. Payments are securely processed by Stripe; we never have access to your card details. The sale is deemed concluded upon receipt of payment.

6. Delivery

Badges are shipped to the address provided at checkout. Shipping costs and lead times are shown before payment and are indicative. In case of abnormal delay, contact us at contact@dropward.life.

7. Right of withdrawal

You have fourteen (14) days from receipt of your order to exercise your right of withdrawal, without having to justify your decision, by emailing contact@dropward.life. As the badge is a standard product (not engraved, not personalized), this right applies in full.

You return the badge in a condition allowing resale. We refund you within fourteen (14) days of receiving the return or proof of its shipment. Return shipping costs remain your responsibility, except for a non-conforming or defective product.

8. Legal guarantees

Regardless of any commercial warranty, you benefit from the legal guarantee of conformity (articles L217-3 et seq. of the French Consumer Code) and the warranty against hidden defects (articles 1641 et seq. of the French Civil Code). For a non-conforming or defective product, we will replace or refund it.

9. Account, profile and availability

Activating the badge requires creating an account. The profile service is provided as is; we do our utmost to ensure its availability but cannot guarantee absolute continuity. You are responsible for the content of your profile and agree to publish only lawful information about yourself (or a person in your care), and not to post unlawful content. We may suspend a profile that is clearly misused.

10. Minors

Purchasing and holding an account are reserved for adults. A badge may be intended for a minor, provided their profile is created and managed by a parent or legal guardian, who takes responsibility for it.

11. Personal data

The profile contains health data. Its processing is described in our privacy policy.

12. Governing law and mediation

These terms are governed by French law. In case of a dispute, please contact us at contact@dropward.life to seek an amicable solution. You may also refer the matter to the European online dispute resolution platform: ec.europa.eu/consumers/odr.
